Contract Terms

  1. Unless cancelled in writing by advertiser within three (3) days of signing, this application shall become binding and noncancelable contract when accepted by AutoBook Magazine ("Publisher") at its offices in Wichita, Kansas. Thereafter, all deposits made hereunder shall be nonrefundable.

  2. Neither party shall be bound by any agreement, understanding or representation not set forth in this application.

  3. In the event that a balance due is not paid on the due date, a default charge computed at the annual rate of 18% and any additional finance charges on such balance due from the date of this application shall also be due and payable.

  4. Publisher agrees to exercise reasonable care that the copy and listing are correctly printed in the magazine and on the internet. The firm name, address and telephone number as shown on the face of this application shall be the criteria for correctness in the magazine and on the internet. If proof is mailed to the advertiser and not returned within the time set forth on the proof sheet, it is agreed that such proofs shall be assumed to be correct.

  5. Advertiser agrees that Publisher shall not be liable for errors in or omissions of the magazine or internet advertising beyond the amount paid for the directory advertising omitted, or in which errors occur, for the issue life of the magazine involved.

  6. All advertising copy is subject to approval by Publisher and no specific position is guaranteed for advertising. Publisher reserves the right to change any classification heading shown on the face of this application in order to maintain standardization of the AutoBook Magazines that will best serve the purposes of the magazine.

  7. Publisher shall not be held responsible for the loss of, or damage to, artwork, photos, slides, negative, or any other source material supplied by advertiser for the purpose of setting display ads.

  8. Redesigned art templates created a second time or changed will have a $75.00 for a redesign fee.

  9. This application authorizes Publisher to use all copyrighted material, trademarks and slogans associated with the ad copy and Advertiser agrees to assume sole responsibility for the protection of the proprietary interest in any such writing or illustrations in the ad copy.

  10. Advertiser assumes full and complete responsibility and liability for the content of all advertising copy submitted, printed and published pursuant to this application, and agrees to defend, idemnify and hold Publisher harmless against any and all demands, claims or liabilities which arise from or which are claimed to have arisen from the use of such advertising copy, together with expenses, including any attorney's fees and court costs incurred by Publisher.

  11. Any balance due hereunder shall be payable upon publication unless otherwise agreed to under billing instructions on the face of this application. All such payments are due and payable to:

    P.O. Box 12442
    Wichita, KS 67277.

  12. Photo and Line ads are designed and discounted for one vehicle listing only. Multiple vehicle listings in the same ad are not permitted. Violators will be charged standard AutoBook Magazine rates and the advertising item will be subject to immediate cancellation. All pricing policies and conditions of AutoBook Magazine will remain in effect.

All About Vehicles, LLC is highly sensitive to the privacy interests of consumers and believes that the protection of those interests is one of its most significant responsibilities. In acknowledgement of its obligations, All About Vehicles has adopted the following Privacy Policy applicable to information about consumers that it acquires in the course of its business:

  1. Acquisition of Information. We do not acquire any more information about
    consumers than is required by law or I otherwise necessary to provide a high
    level of service efficiently and securely.
     
  2. Our Employees and Privacy. We train all our employees about the
    importance of privacy. We give access to information about consumers only
    to those employees who require it to perform their jobs.
     
  3. Security Measures. We make access to privacy-sensitive information subject
    to rigorous procedural and technological controls, consistent with legal
    requirements and the demands of customer service.
     
  4. Disclosure to Third Parties. We will provide individually-identifiable
    information about consumers to third parties only if we are compelled to do so by order of a duly-empowered governmental authority, we have the express permission of the consumer, or it is necessary to process transactions and provide our services.
     
  5. Privacy and Our Business Partners. When we make our technology or
    services available to business partners, we will not share with them any more consumer information than is necessary, and we will make every reasonable effort to assure, by contract or otherwise, that they use our technology and services in a manner that is consistent with this Privacy Policy.
